TERMS OF AGREEMENT
Originality
By completing and submitting the Entry Form, my ("Entrant") Parent/Legal Guardian (if under 18 years of
age at the time of submitting the Entry Form) and Entrant certify that the work Entrant is submitting
("Submitted Work") is Entrant's original work. This means Submitted Work is not copied from a published
work by any other individual or entity, and it contains no matter that infringes on any existing copyright,
trademark, or right of privacy.
Publicity & Copyright Release
By completing and submitting the Entry Form, Entrant's Parent/Legal Guardian (if applicable) and Entrant
irrevocably and in perpetuity grant and assign to Sunflower Broadcasting, all worldwide right, title, and
interest in and to the Submitted Work and to all intellectual property Entrant created arising out of Entrant's
participation in the CatchitKansas PSA Contest . The ownership of same shall be vested completely in the
Sunflower Broadcasting for its own use and disposition. With regard to copyright, this assignment shall be
effective for the entire duration of the copyright in and to the Submitted Work in all countries throughout the
world and shall include, but not be limited to, all rights to derivative works and the right to alter the Submitted
Work at the sole discretion of the Sunflower Broadcasting. Entrant's Parent/Legal Guardians and Entrant
waive all rights of attribution and integrity with regard to the Submitted Work in respect of all marketing,
advertising, and commercial uses thereof. Entrant acknowledges that the Sunflower Broadcasting is free to
commercially utilize the Submitted Work and no further compensation shall be paid to Entrant for such use.
RELEASE FORM
By submitting your Public Service Announcement to the PSA Contest, you agree to the following terms and conditions:
In consideration of the opportunity to appear in certain news, promotional or other type of programming (collectively the "Programs") for Sunflower Broadcasting, Inc., and other good and valuable consideration, I hereby irrevocably grant Sunflower Broadcasting, Inc, its parent, affiliated or related companies, successors, employees, distributors, agents, partners, licensees and assignees (hereinafter collectively "Sunflower Broadcasting, Inc.") the following rights:
1. Sunflower Broadcasting, Inc. may hereby record my name, voice, likeness and biographical or other information supplied (collectively the “Material”) and may use such recordings, in its sole discretion, including, without limitation, the right to use, incorporate, broadcast, distribute, re-use, alter and/or edit the Material (regardless of whether or not I am recognizable) for any purpose and in any manner whatsoever as Sunflower Broadcasting, Inc. so chooses in all media throughout the universe, now known or hereafter devised, in perpetuity. I further agree that Sunflower Broadcasting, Inc. may use the Material in connection with any promotion, advertising, merchandising and publicity for Sunflower Broadcasting, Inc.
2. I warrant that I have the right to grant these rights and that Sunflower Broadcasting’s use of the Material will not violate the rights of any person or organization and will not incur any liability for payment to any person or organization. I further agree that I hereby fully and knowingly release Sunflower Broadcasting from any liability or other damages arising from Sunflower Broadcasting’s use of the Material and my participation in the Programs, including, without limitation, any and all injuries I may suffer during the course of the recording of the Material, and any claim that use of the Material invades any right of privacy and/or publicity. I further agree that this release will be binding on my heirs, successors and permitted assignees, if any.
3. I agree that Sunflower Broadcasting, Inc. may copyright the Material and may license others to use the rights granted herein, in all media in perpetuity throughout the universe. I acknowledge that Sunflower Broadcasting, Inc. is not required to use any portion of my appearance, and that the Programs may never be broadcast.
4. This agreement constitutes our entire understanding with respect to the Sunflower Broadcasting’s recording and use of the Material and cannot be amended except by a written instrument signed by the parties hereto.
5. I understand that Sunflower Broadcasting, Inc. is recording the Material in reliance on this consent.
